This document contains both our Privacy Policy and Terms of Service. By using AI Scan Report ("we," "our," or "the Service"), you agree to both policies.

PART I: TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing or using AI Scan Report services at aiscanreport.com, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, do not use our Service.

Age Requirement: You must be at least 18 years old and have the legal authority to enter into contracts to use our Service.

2. SERVICE DESCRIPTION

AI Scan Report provides business intelligence analysis by querying multiple AI models (including but not limited to OpenAI, Anthropic, Google, and xAI systems) to assess what these AI systems report about business entities.

Important: Our Service:

• Reports AI system outputs, not factual business evaluations
• May contain incomplete, inaccurate, or fabricated information generated by AI systems
• Is designed to identify AI knowledge gaps and potential hallucinations
• Does not constitute professional advice of any kind

3. NO REFUNDS POLICY

ALL SALES ARE FINAL. NO REFUNDS WILL BE PROVIDED UNDER ANY CIRCUMSTANCES.

By purchasing our Service, you acknowledge and agree that:

• Payments are non-refundable once processing begins
• You have inspected our sample reports and understand the Service
• Digital reports cannot be "returned"
• Sparse or limited AI knowledge about a company is precisely what the Service is designed to identify
• You will not initiate chargebacks or payment disputes

4. NO WARRANTY DISCLAIMER

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE SPECIFICALLY DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY OR COMPLETENESS OF INFORMATION
• NON-INFRINGEMENT
• TITLE
• QUIET ENJOYMENT

AI Output Disclaimer: AI systems may produce:

• Hallucinations (fabricated information)
• Outdated information
• Confusion between similar entities
• Inconsistent results across different queries
• Varying results based on model updates

5. LIMITATION OF LIABILITY

IN NO EVENT SHALL AI SCAN REPORT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Lost profits, revenue, data, or business opportunities
• Damages exceeding the amount paid for the Service
• Any reliance on AI-generated content
• Actions taken based on report contents

YOU USE THE SERVICE AT YOUR OWN RISK.

6. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless AI Scan Report from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your use of report information
• Scanning entities without proper authorization
• Any business decisions based on our reports

7. INTELLECTUAL PROPERTY

All Service content, features, and functionality are owned by AI Scan Report and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to view your purchased reports for internal business purposes only.

You may not:

• Resell or redistribute reports
• Create derivative works
• Reverse engineer our methodologies
• Use our branding without permission
• Share login credentials

8. ACCEPTABLE USE

You agree NOT to use the Service to:

• Scan individuals (only business entities permitted)
• Violate any laws or regulations
• Infringe on privacy rights
• Engage in harassment or defamation
• Scan entities for illegal purposes
• Attempt to manipulate AI training data

9. ACCOUNT TERMINATION

We reserve the right to suspend or terminate your account immediately for:

• Violation of these Terms
• Fraudulent payment activity
• Abusive behavior
• Legal compliance requirements
• At our sole discretion

Upon termination, you lose access to all reports and services with no refund.

10. MODIFICATIONS TO TERMS

We may modify these Terms at any time. Continued use after changes constitutes acceptance of modified Terms. We are not required to notify you of changes.

11. DISPUTE RESOLUTION

Governing Law: These Terms are governed by the laws of the state of California, USA.

Arbitration: Any disputes shall be resolved through binding arbitration under AAA rules, not through court proceedings.

Class Action Waiver: You waive any right to participate in class action lawsuits.

PART II: PRIVACY POLICY

12. INFORMATION WE COLLECT

Account Information:

• Email address
• Company name (for scanning)
• Password (encrypted)
• Payment information (processed by Stripe)

Automatically Collected:

• IP address
• Browser type and version
• Device information
• Usage analytics
• Cookies and similar technologies

Report Data:

• Companies you scan
• Report generation history
• API query logs

13. HOW WE USE INFORMATION

We use collected information to:

• Provide and improve the Service
• Process payments
• Send service-related emails
• Detect fraud and abuse
• Comply with legal obligations
• Develop new features
• Technical support

We do NOT:

• Sell your personal information
• Share data with scanned companies
• Use your data to train AI models

14. COOKIES AND TRACKING

We use cookies for:

• Remembering preferences

Cookie Control: You can disable cookies in your browser, but this may limit Service functionality.

• Azure: Cloud hosting and data storage
• Google Analytics: Usage analytics
• AI APIs: OpenAI, Anthropic, Google, xAI (queries only, no personal data shared)

16. DATA SECURITY

We implement industry-standard security measures including:

• SSL/TLS encryption
• Encrypted password storage
• Secure cloud infrastructure
• Regular security audits
• Access controls

However, no method of transmission over the Internet is 100% secure.

17. DATA RETENTION

• Account data: Retained while account is active plus 1 year
• Reports: Accessible for 3 years after generation
• Payment records: 7 years for tax/legal compliance
• Logs: 90 days

18. YOUR RIGHTS

You have the right to:

• Access your personal information
• Correct inaccurate data
• Delete your account (no refund)
• Opt-out of marketing emails
• Request data portability

California Residents (CCPA): Additional rights to know, delete, and opt-out of sale (though we don't sell data).

EU/UK Residents (GDPR): Additional rights including rectification, restriction, and data portability.

19. CHILDREN'S PRIVACY

Our Service is not intended for anyone under 18. We do not knowingly collect information from minors.

20. INTERNATIONAL TRANSFERS

Your data may be transferred to and processed in the United States where our servers are located. By using the Service, you consent to such transfers.

21. DO NOT TRACK

We do not respond to Do Not Track browser signals.

22. CHANGES TO PRIVACY POLICY

We may update this Privacy Policy at any time. Continued use constitutes acceptance.

23. AI-SPECIFIC DISCLAIMERS

No Professional Advice: Reports do not constitute legal, financial, investment, or professional advice. Consult qualified professionals for such matters.

AI Limitations:

• AI knowledge cutoff dates vary by provider
• Models may be updated without notice
• Results can vary between queries
• Training data may contain biases

Not a Guarantee: We do not guarantee AI models will have any information about your company.

24. MONITORING SERVICE

For accounts with monitoring:

• Updates occur when AI models have major updates (typically 2-3 times yearly)
• Alerts sent for significant changes only
• No guarantee of detecting all changes
• Service continues for one year from purchase

25. SAMPLE REPORTS

Sample reports are for demonstration only and may not reflect current AI capabilities or your specific results.

26. FORCE MAJEURE

We are not liable for delays or failures due to causes beyond our control, including but not limited to acts of God, government actions, AI provider outages, or Internet disruptions.

27. ENTIRE AGREEMENT

These Terms and Privacy Policy constitute the entire agreement between you and AI Scan Report, superseding any prior agreements.

28. SEVERABILITY

If any provision is found unenforceable, the remaining provisions will continue in full force.

29. NO WAIVER

Our failure to enforce any right or provision shall not constitute a waiver.
